Republicans in Congress have said the next Supreme Court justice should not be nominated until a new president is elected and have vowed not to approve any nominations put forward by President Obama.

We asked readers whether President Obama should nominate a Supreme Court justice to fill Antonin Scalia's seat, following the U.S. Senate leadership's promise not to give a hearing for the nominee.

Mr. Portman of Cincinnati is not on the Senate Judiciary Committee that would hold confirmation hearings.

"Reality is sinking in for voters in both parties that the next president will likely appoint two or three justices to the U.S. Supreme Court, which will impact our nation for decades to come", he said. Currently, the court is composed of three Republicans, two Democrats, and one independent, Jaynee LaVecchia, who is unaffiliated with either party. Some commentators and politicians have suggested there is a "tradition" of holding Supreme Court vacancies open in presidential election years.

Republicans have harshly criticized President Obama for taking executive action which they consider beyond the scope of his powers and duties under the Constitution. Clearly corporations and unions are factions, and a strict constructionist should know that granting them the rights of individuals was judicial activism, not restraint.

That's what happens when Justices make decisions based on their personal policy preferences, or what's in their "heart", rather than on the Constitution and the law.

Given these facts, it is important to note the wise advice Justice Scalia left the nation concerning what turns out to be his own replacement.
